Homeowners ask: "So, I have title insurance now... doesn't that protect me from future fraudulent activities such as recording fake deeds and fraudulent mortgages?
The answer is - NO!
Title Insurance protects against certain unknown matters that occurred in the past and/or already existed of record on the day you purchased your home, that is why only a one-time premium is collected. In order to guard yourself from future activity that may cause you harm or damage, you must first have a service in place that notifies you of any new recording activity in the County Clerk's Office. The Clerk's Office does not and cannot reject the recording of a document if it is properly executed and duly notarized.
